At Chafes we deal with all aspects of family and matrimonial matters including divorce, financial arrangements following marriage breakdown, financial arrangements for unmarried couples, national and international children matters, care & adoption proceedings, domestic violence.
Our family team is headed by Pete Littlewood BA(Hons) who is a member of Law Society Children Panel and an Advanced Member of Law Society Family Panel. Pete is also an Accredited Specialist in the areas of Children Law (private), Advocacy, Financial Provision and Domestic Abuse.
All of our Solicitors are members of Resolution (formerly Solicitors Family Law Association) which adopts a non confrontation approach in resolving family matters. Some of our solicitors are also trained in collaborative family law.
Divorce
We can advise you whether your circumstances would give rise to commence divorce proceedings and also assist you with preparing the necessary documentation to legally dissolve a marriage.
We also have trained collaborative lawyers who will work with clients, should they choose the collaborative approach.
Marriage Breakdown (Financial Arrangements)
Obtaining a divorce does not prevent your ex-partner from making a financial claim against you. It is therefore essential that you formalise any financial arrangements that are made.
We can advise you on the financial settlement that you are entitled to, negotiate with your ex-partner and, if an agreement cannot be reached out of Court, we can represent you in court proceedings.
Unmarried Couples (Financial Arrangements)
We can advise on whether you have a financial claim against any property owned either in sole names or jointly with an ex partner.
We can also assist with drafting Living Together Agreements which set out your financial arrangements when you are cohabiting and advise you upon Pre Nuptial Agreements.
Children
We can negotiate arrangements for contact between a child and parents that have separated and if it is not possible to reach an agreement we can represent you in any court proceedings that may be necessary.
If a child is either taken out of this country or brought to this country against your wishes we can give advice as to your rights in this area of law, governed by the Hague Convention for recovery of that child.
Domestic Violence
In cases of domestic violence we can obtain an Order of the Court prohibiting the use of violence and, where appropriate, excluding a violent partner from the property.
We can also offer advice on local telephone helplines and support services that can assist with the other aspects of these difficult situations.
